GRACIE COOS COUNTY LLC LIABILITY WAIVER

Definitions

“Releasees” means Gracie Coos County LLC, Timothy Brownfield, and their coaches, instructors, staff, affiliates, other participants, sponsors, and each of their officers, directors, agents, and employees, at any Gracie Coos County LLC location, currently Coos Bay and Coquille, Oregon.

Release, Assumption of Risk & Scope

In exchange for being allowed to participate in Gracie Coos County LLC programs, classes, and events, Participant (and Participant’s parent/guardian, if a minor) waives, releases, and relinquishes all claims for personal injury, property damage, or wrongful death arising from jiu-jitsu, wrestling, grappling, or mixed martial arts training, however occurring, on behalf of Participant’s heirs and assigns.

Participant assumes all risks of this training, including bodily injury, disability, paralysis, and death, whether caused by negligence of Participant, other participants, or Releasees, and understands risk increases with larger, faster, stronger, or more experienced partners, including risks not now foreseeable.

This release covers ordinary negligence only. It does NOT release Releasees’ gross negligence, recklessness, willful misconduct, or intentional acts. Oregon courts scrutinize broad releases that fail to make this distinction — see Bagley v. Mt. Bachelor, Inc., 356 Or. 543 (2014).

Premises, Health Risk & Indemnification

Participant assumes risks from Gracie Coos County LLC mats and premises at any location, including skin, bacterial, fungal, and viral infection (including staph and ringworm), exposure to bloodborne pathogens (including but not limited to Hepatitis B, Hepatitis C, and HIV) through contact with blood, open cuts, or abrasions during training, and other illness spread through close-contact training, and any claim from premises maintenance, supervision, or staff selection, subject to the negligence scope above.

Participant (and, if a minor, Participant’s parent/guardian individually) agrees to defend, indemnify, and hold harmless Releasees from any claim arising from Participant’s injury or death. There is no coverage for claims of one participant against another. If Participant is a minor, the signing parent/guardian understands Participant may bring a personal claim upon reaching adulthood, and individually agrees to indemnify Releasees for any resulting cost or judgment.

Locations, Digital Dojo & Media

This agreement covers all Gracie Coos County LLC locations (currently Coos Bay and Coquille) without a new signature per location, and supervised Digital Dojo online instruction. Participant acknowledges unsupervised solo drilling from Digital Dojo video content carries risk similar to in-person training, without a coach present to correct technique, and assumes that risk.

Separately and revocably at any time in writing: Gracie Coos County LLC and Coos County Combat Crew (C4) may photograph/video Participant for promotional and social media use unless declined below.

Dispute Resolution & Severability

Disputes under this agreement go first to good-faith mediation, then to final, binding, individual arbitration — not class, collective, or representative action — under Oregon law, with venue in Coos County, Oregon for any matter not subject to arbitration. If any provision is held unenforceable, the remainder of this agreement remains in full force.

Acknowledgment

Participant (and parent/guardian, if applicable) has read this entire agreement, had the opportunity to consult an attorney, and has not relied on any representation outside this document. Participant understands the risks of this training and that this agreement is a condition of participating in Gracie Coos County LLC programs.
